Operating capital was short. According to a lawsuit filed in San Francisco Superior Court, a new chief financial officer started in April — David Haase — who had overlapped with Rothenberg at Stanford. In May, Rothenberg asked him to open an American Express card in Haase’s name for business expenses, which would be relayed to him by one of Rothenberg’s three executive assistants. Rothenberg paid him back for a $140,000 bill. Haase says he then racked up another $109,352 in business expenses — and he’s still waiting for the payment. Haase claims that the expenses for Rothenberg Ventures and River Ventures were commingled, and that Rothenberg “treated such accounts as personal accounts, to such an extent that such business entities were in fact his alter ego.” (Rothenberg wouldn’t speak to the specifics of the suit but responded, “Rothenberg has always reimbursed our staff for legitimate, approved business expenses.”)
Guidant officials said on a conference call that they expect additional suits, but they characterized the company’s liability in the matter as “manageable.”

That means that, for example, the Treasury Board gets the benefits of someone else’s user interface testing. “We’re still evolving with learning how to do user experience and improving the useability of our website,” Jackson says. “But there are a lot of firms out there that are dedicated to that very purpose. That’s why people are still making Dreamcast games, why fans are still playing them and why cranks and fans continue cooking up hoaxes around the console. We may be ten years out, but there’s still something about the Dreamcast that won’t let us just walk away.

To be sure, there’s a legitimate argument to be made for publishing Manning’s chats. The key question (to us): At what point does everything Manning disclosed in confidence become fair game for reporting, no matter how unconnected to his leaking or the court-martial proceeding against him, and regardless of the harm he will suffer? That’s a debate we have had internally at Wired with every major development in the case.

Recently I visited a relative on the eastern end of Long Island, about 90 miles outside New York City. The heat was brutal, and the house had no air conditioning and wasn’t accommodating to breezes – so on the first night I arrived, I sat out on the deck as the sun sank and the air cooled. Just as it became too dim to see the far end of the garden, there was a thrashing noise, as though something had gotten caught in the hedge beyond the pool, and then a whffft as whatever had tangled itself sailed over the obstacle. A moment later, something spiny but soft-edged poked into the sliver of light from the window, and bobbed, and bowed toward the ground. The spiny bits were antlers; the intruders were two white-tailed bucks, at least a year old, come to munch on the unattended lawn.
